Major Changes to the new Covenants

Besides removing about 55 references to the original 'Developer,' and the 25 times the Golf course is mentioned, with the help and advise from the Board, our Covenants Attorney, and others:

​

~ Dropped requirements for the Architectural Review Committee (ARC) to approve or disapprove small Satellite Dishes [smaller than 3 feet wide], Utility Yards, window Air Conditioners, walkways, or Dog or Pet Houses.

 

~ Removed the requirement for planting or screening in front of Air Conditioners.

 

~ Allowed for the possibility of adding some permanent fixtures,* with ARC approval, such as Benches, Picnic Tables, Fire Pits, Trampolines, or Playground Equipment. (*Permanent means those items that are bolted into a concrete pad or built into the ground.)

 

~ Created a simple “List of Items Requiring ARC Approval.” 

 

~ Added references to the ARC’s “Building Requirements Handbook.” 

 

~ Dropped the rule about only allowing only two dogs, as long as pets or animals do not endanger other resident’s safety, and don’t unreasonably disturb others.

 

~ Made the rules about vehicle Parking, and Signs much more flexible.

 

~ Added that owners may have Vegetable Gardens in their back yards (without ARC approval).

 

~ Cautioned that Builders and Owners can NOT plant invasive trees or shrubs, as they can damage water lines and cause cracks in walkways and driveways

 

~ Worked to protect our larger Trees from being cut down by Builders, and required that new homes must normally include a minimum of two Trees, approved by the ARC.

 

~ Improved the ‘Site Plan’ requirements for Contractor or Owner construction, to be sure it covered: grading and drainage plans; foundation plans; landscape plans, types of new trees and shrubs and where they will be placed; exterior elevation drawings, retaining walls, fences, walkways, garden structures, and types of construction materials.

 

~ Improved the descriptions of what constitutes a Nuisance, and how weekly Trash and Bulk Trash are to be handled.

 

~ Stopped forbidding our resident's trucks in driveways (Yes, that is in the 1990 covenants), and noted that residents are allowed to have a truck or van with a corporate logo or advertisement. This does not include Commercial Vehicles, which are also now better defined.

 

~ Added more information about constructing a Driveway. Added that no Carports are allowed.
 
~ Allowed for the temporary parking of a vehicle on lawns when necessary, and that residents can park motor homes or recreational vehicles (RVs), and portable storage containers (PODs) for up to two weeks on their driveway – but after that, Board approval is needed.

~ Added that Moving Vans may remain up to 2 days, but after that they require Board approval. 

 

~ Added wording to make it easier to turn our Private Sewers and Streets, over to the City of Maryville IF that ever becomes possible.

​

~ Simplified how future Amendments to the Covenants will be made.
